General Terms and Conditions

Active Elements

On specified itineraries some active elements are incorporated into the tour. To enjoy the tour as intended a minimum level of fitness is required to participate. The level required would be equivalent to what is obtained by routine daily exercise such as golf, jogging, energetic walking, tennis, ... Activities during the tour could include (but are not limited to) trekking, hiking, off road walking, cycling, kayaking and navigating uneven terrain. Should you have any questions or need any clarification about a specific tour. Please ask for details at time of booking.

Travel Documentation

Passport, Visa and Health requirements are the responsibility of all individual travelers. Passports are required for all travelers with the minimum validity of 06 months. The posting/ couriering of travel documentation is the responsibility of you. The agent will not be held responsible for tickets lost by a third party, any charges associated with reissue and resending of documentation will be at your expense. 

Fares & Prices

Airfares and prices are subject to change until full payment is received and are subject to Airline/ provider availability. The general booking form constitutes a request only and we do not guarantee fares or prices until the booking has been confirmed by one of our consultants and paid for. Airline/ hotel/ car availability, fare conditions and class of travel can change at any time. Routing restrictions and other special conditions may apply. Taxes, airport charges and any additional costs will be advised to you when your booking is confirmed. Airlines and other suppliers may change their prices without notice. 

Included in quoted programs:
- Ground transportation in air conditioned vehicle
- Domestic flight or train tickets
- All accommodation as noted in the itinerary based on twin/ double sharing with daily breakfast.
- Meals as specified in the itinerary
- Fully guided sightseeing as noted in the itinerary including park and entrance fees
- Bottled water supplied during adventure activities (not applicable for sightseeing activities & kayaking)

Excluded in quoted programs:
- Airport transfer unless otherwise stated
- Early check in and late check out unless otherwise stated
- International airfares unless otherwise stated
- Visa fee and visa arrangement fee
- Airport departure taxes
- Gratuities and tips for hotels/ restaurant staff, porters, local guides, drivers, tour leaders
- Meals other than specified in the itinerary
- Beverages other than included in pre-tour documentation
- Sightseeing not included in the itinerary
- Personal expenses such as laundry, communication charges and optional activities (which are subject to availability)

Children and Infants
 

For all tours children (from six to twelve years of age at the time of booking) are charged 75% of adult price. Children from two to six years are charged 50% of adult price. Infants (under two years of age at the time of booking) are charged 10% of adult price otherwise stated in the tour program.

Deposit

For all programs a non refundable deposit of US$ 200.00 per person is required at the time of booking. Final payment is due 60 working days prior to your arrival. If your reservation is made within 60 days of departure, the entire cost of the trip must be paid at the time of confirmation.

Cancellation

- Cancellations for GIT will be charged as follows:
+ More than 60 days before arrival: No cancellation charge (US$ 100.00 non refundable deposit will be forfeited)
+ 30 – 60 days before arrival: 10% of tour price
+ 15 – 29 days before arrival: 30% of tour price
+ 07 – 14 days before arrival: 80% of tour price
+ Less than 07 days before arrival: 100% of tour price

- Cancellations for FIT will be charged as follows:
+ More than 30 days before arrival: No cancellation charge (US$ 100.00 non refundable deposit will be forfeited)
+ 14 – 30 days before arrival: 10% of tour price
+ 07 – 14 days before arrival: 30% of tour price
+ 03 – 07 days before arrival: 40% of tour price
+ Less than 03 days before arrival: 50% of tour price

- Cancellations of extra services

For additional hotel nights and other extra services booked in connection with tour programs, cancellations will be charged as follows:
+ More than 30 days prior to the service will be refunded in full
+ 15 – 30 days in advance: 50% of the price
+ Less than 15 days in advance: 100% of the price.

Amendments/ Alternations

An amendment fee of US$ 50.00 per person will be applied every time a confirmed booking requires amendments.

5.   Inevitable cause:
Neither party shall be responsible for any damages caused by inevitable causes whatever and however beyond the control of the parties affected by, but not limit to, decrees of the Government or Government Agencies, refusal of Government Authorizations, Court instructions, hail storm, Act of God, the public enemy, strikers, fire, flood, explosions, earthquakes, epidemics, riot, war, rebellion, or quarantine restriction.
Vietsky Travel is responsible for the implementation of all programs booked by party, but reserves the right to switch around their itineraries where actual circumstances demand. Furthermore, it may have to change a certain program due to external causes lying beyond its control but will replace the services cancelled with those of a similar value. However, any changes must be in writing by the other side first.

6.   Arbitration:
6.1  This agreement shall confirm to the Law of the Socialist Republic of Vietnam.
6.2 Any dispute or claim concerning the scope, meaning, interpretation, or execution of this agreement or arising under, cut of or in connection with the agreement shall be amicably consulted and settled. Failure to do so, the said depute/claim shall be referred to the Vietnam  International Arbitration Center at the Chamber of the Commerce & Industry of S.R. Vietnam for conclusive decision to be binding upon both parties. To settle the said dispute / claim the Vietnamese legislation and regulation are to be applied.
